Vice apparent vs garantie décennale : un rappel utile de la CA de Versailles
L’acquéreur d’une maison se plaignait de désordres d’humidité et de non-conformités au permis de construire, sollicitant une indemnisation sur le fondement de la garantie décennale.
La Cour opère un revirement par rapport au jugement de première instance.
Elle rappelle d’abord qu’un désordre apparent lors de la vente — en l’espèce matérialisé par la présence d’un déshumidificateur et l’absence d’aggravation — ne peut relever de la garantie décennale. Résultat : aucune indemnisation au titre des travaux réparatoires ni du préjudice de jouissance.
Sur la non-conformité administrative, la Cour adopte une approche pragmatique : seuls les travaux effectivement réalisés et justifiés peuvent être indemnisés.
À retenir : la connaissance ou le caractère apparent d’un désordre est déterminant pour écarter la garantie décennale. Le préjudice indemnisable doit être strictement corrélé à des travaux réellement effectués et prouvés.
