Jeunes travailleurs exposés aux rayonnements ionisants : évolution des critères de protection
Par un décret du 8 avril 2026 (Décret n°2026-260 du 8 avril 2026), le Gouvernement fait évoluer les règles applicables à la protection des jeunes travailleurs exposés aux rayonnements ionisants, en adaptant le Code du travail aux évolutions du droit européen et du cadre réglementaire actuel.
Le texte modifie l’article D 4153-21 du Code du travail et remplace l’ancien critère fondé sur le classement des travailleurs en catégorie A ou B par une nouvelle référence : l’existence d’une surveillance dosimétrique individuelle prévue à l’article R 4451-64 du Code du travail. Jusqu’à présent, certaines interdictions ou restrictions applicables aux jeunes travailleurs dépendaient du classement du salarié au regard de son niveau d’exposition aux rayonnements ionisants.
Désormais, le critère déterminant repose sur l’obligation de surveillance dosimétrique individuelle. L’objectif est d’harmoniser la terminologie avec les dispositifs actuels de prévention et de suivi des expositions. Les employeurs devront donc apprécier les situations au regard du suivi dosimétrique réellement mis en place.
Ce décret s’inscrit dans une logique de modernisation des règles de prévention des risques professionnels et de mise en conformité avec la directive européenne 2013/59/Euratom.
